The material on this website (including without limitation images, text, branding, software and information) is protected by copyright under the laws of Australia and the laws of other countries under international treaties. Do not copy, communicate, adapt, transfer or distribute any of the contents without our written permission first. No trade mark or logo on this website may be used in any way without prior written permission.

Offers
We might publish certain offers, trial periods, programs or promotions on our website. We will set up a dedicated space for any applicable T&Cs so make sure you check those terms before entering or participating. We will sometimes add, remove, alter or amend offers or promotions on our website as permitted by law, so do check back in.

Purchase Terms

Account registration
To purchase our products you may decide to set up an account and be logged in using a valid email address. You are responsible for ensuring that your account details are accurate and up to date, and for keeping your account details and password confidential.

Orders
You can place an order by following our website prompts. We accept orders from all parts of Australia at present, but please email us for a customised shipping quote or more information about international shipping if you are outside of Australia and would like to discuss further. We reserve the right to accept or reject your order for any reason, including if the requested product is not available, there is an error in the price or product description on this website or an error in your order – but we will be sure to let you know as soon as possible. Each order that we accept results in a separate binding agreement between us for the supply of that product on these Terms.

Payment
All prices are in Australian dollars and are inclusive of any applicable GST. We accept payment via debit or credit card (major credit cards accepted by our payment gateway platform, Stripe), PayPal, over the phone direct deposits, or any other express checkout provider listed on checkout. We do not offer AfterPay or payment plan services. You will be charged during the purchasing process and prior to delivery or collection. If we are unable to charge your credit or debit card due to insufficient funds or other errors your order will be cancelled, and we’ll get in touch.

Stripe
We use Stripe to process credit card payments, and this payment method is subject to the terms and conditions of Stripe available at their website: www.stripe.com. By proceeding with an order, you agree that you have read, understand and agree to those terms (Processor Terms). We are not a party to the Processor Terms and are not liable to you in connection with the Processor Terms. If you do not agree to the Processor Terms, please use the PayPal or over the phone direct deposit payment options.

Collection
We may offer a ‘Click & Collect’ option that allows you to place an order online and collect the products from our nominated office or collection location as specified at checkout. Collection from our nominated address is available between 9am-4pm upon agreement and products must be collected within 7 business days from the date you are notified that the order is ready for collection. If you do not collect your order within this timeframe, we may cancel the order and issue a refund (less any reasonable handling or restocking costs) or charge reasonable storage fees until the order is collected.

Delivery

We will deliver products via Australia Post or another carrier to the Australian delivery address you have nominated in your order.
Once your order is dispatched, it is not possible to change your nominated delivery address given the timeframes with which we pack orders.
You can schedule a specific day of the week for your order to be delivered, but not a specific time as our couriers may arrive at your selected address any time between 9am and 5pm on that day.
You will receive a tracking number via email once your order has been dispatched. If you are not home to receive your order it will be taken to the nearest Post Office for safekeeping and you will need to collect it. Alternatively, if you have chosen to receive unattended delivery (‘Authority to Leave’), our delivery providers will leave your order in a suitable spot at your nominated delivery address.
Delivery times may vary depending on the carrier and delivery address. We recommend allowing at least 2-7 business days for delivery.
If applicable, delivery fees will be communicated to you before you place your order and must be paid at the same time and in the same manner as you pay for your order.
You promise and warrant that the person receiving products at your nominated delivery address is authorised by you to do so.
Please ensure access to your selected delivery address is unobstructed without hazards (including unrestrained animals) that could endanger our delivery providers.

Changing or cancelling orders
Once you have placed an order it is not possible to change or cancel the order or your payment method, because of the timeframe in which your order is picked and packed for delivery or collection.

Out of stocks and substitution
It’s rare, but if you place an order for a product that is out of stock or unavailable, we will endeavour to notify you as soon as possible and arrange either a refund or supply of a substitute product.

Returns and refunds
Please choose carefully as, due to the nature of our products, we do not offer refunds or returns for change of mind, personal preference or incorrectly purchased products. If you receive a damaged product, or a product item is missing, you can make a claim for a refund or replacement. To lodge a claim, please send us an email with a clear photo of the damaged product or description of missing items to sales@flavourcreations.com.au within 7 days of receiving your order. Please ensure that you keep hold of any damaged products until we advise that they can be discarded. Our products come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law if we breach a consumer guarantee.

No retail or resale
You may only use this website for personal purposes unless we provide written consent otherwise. You are not permitted to purchase any of our products for resale to a third party for retail, wholesale or trade purposes without our prior written consent.

Risk
Risk in products passes to you on the date and time of delivery to the delivery address nominated in your order (including for unattended deliveries) or time of collection. You are responsible for the safe keeping of your order once it is left at your nominated address

Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. For major failures with a good, you are entitled to choose a refund or replacement. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund of the price paid for the goods and to cancel any contract for the service and obtain a refund of any unused portion. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Reviews
We want to hear what you think, but we also have a responsibility to keep this a safe space. Any materials or content you submit or publish about our business, products or services may be changed, condensed or deleted if we reasonably consider it to be in violation of content guidelines or any other provision of these Website Terms. We cannot guarantee that you will be able to edit or delete any material or content you submit or publish. Ratings and written comments are generally posted in a timely manner, however we reserve the right to remove or refuse to post any submission, including if we reasonably consider the post to be in breach of these Terms or other applicable content guidelines. You acknowledge that you are solely responsible for the contents of any review or submission you make.

You agree to indemnify, defend and hold Flavour Creations, its and their officers, directors, employees, affiliated or related entities, agents, licensors, and suppliers, harmless from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including legal fees) resulting from your use of this Website, your breach of any provision of the Terms and/or any negligent acts, omissions or intentional wrongdoing by you.

Applicable law
We operate this website from Australia. The laws of New South Wales govern these Terms. If any part of these Terms is found to be unenforceable, you agree that the rest remain in full force and effect.
